Terms of Service
These Terms govern your use of Passport-Photo.co.uk and all related photo-processing, checkout, delivery, and support services.
1. Agreement
By using this site or placing an order, you agree to these Terms, our Privacy Policy, and our Refund Policy. If you do not agree, do not use the service.
2. Service Scope
We provide digital tools that help create passport-style photo outputs and related delivery artifacts. We do not issue official identity documents and do not control final decisions made by governments, embassies, or other authorities.
3. Eligibility and Accountability
- You must be legally capable of entering a binding contract in your jurisdiction.
- You must provide accurate information at checkout and in any support claim.
- You are responsible for ensuring your uploaded content is lawful and authorized.
- If uploading data for another person, you confirm you have authority and valid consent.
4. Acceptable Use and Restrictions
- Do not use the service for unlawful, fraudulent, abusive, or infringing activity.
- Do not bypass access controls, payment steps, security checks, or rate limits.
- Do not scrape, reverse engineer, or run automated abuse at scale.
- Do not upload malware, harmful files, or content that violates rights of others.
5. Orders, Pricing, and Payment
- Prices and package descriptions are shown at checkout and may change prospectively.
- Payment is processed via third-party providers; we do not store full card details.
- Your order is confirmed when payment succeeds and confirmation is issued.
- You are responsible for checking package and order details before payment.
6. Digital Delivery and Cancellation
Our service includes digital content supplied on demand. At checkout, you may be asked to expressly request immediate processing and acknowledge that cancellation rights can be reduced or lost once digital supply begins, to the extent permitted by law.
This clause does not remove rights that cannot be excluded under mandatory consumer law.
7. Guarantee and Refund Terms
Any acceptance guarantee or refund entitlement is governed by the Refund Policy and applies only within its conditions and evidence requirements.
8. User Content and License
- You retain ownership of your uploaded content.
- You grant us a limited, non-exclusive license to host, process, transmit, and display that content to provide the service, support, security, and legal compliance.
- This license ends when data is deleted, except where retention is required for legal obligations or dispute defense.
9. Intellectual Property
Our software, site design, branding, and service materials remain our intellectual property or licensed rights. No rights are granted except as expressly stated.
10. Service Availability
We aim for high availability but do not guarantee uninterrupted, error-free, or always-on operation. We may update, suspend, or discontinue features where reasonably necessary.
11. Suspension and Termination
We may suspend, limit, or terminate access where we reasonably believe there is abuse, fraud, unlawful use, security risk, non-payment, or material breach of these Terms.
12. Warranties and Disclaimers
To the extent permitted by law, services are provided on an "as available" basis. We do not guarantee final acceptance of any photo by any authority.
13. Limitation of Liability
- Nothing in these Terms excludes liability that cannot be excluded by law.
- We do not exclude liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.
- To the maximum extent permitted by law, we are not liable for indirect, special, incidental, or consequential losses.
- Subject to mandatory law, our total aggregate liability for a claim is limited to the amount paid for the relevant order.
14. Consumer Statutory Rights
Nothing in these Terms limits statutory consumer rights, including rights relating to faulty digital content under applicable consumer law (including UK Consumer Rights Act 2015 where applicable).
15. Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales. Courts of England and Wales have non-exclusive jurisdiction, and mandatory consumer protections in your home jurisdiction remain unaffected where applicable.
16. General
- If any provision is invalid, the remaining provisions continue in force.
- Failure to enforce a right is not a waiver of that right.
- These Terms form the entire agreement between you and us for the service use covered here.
